Terms of Service

1. About these terms

These Terms of Service (the "Terms") govern your access to and use of the FINSAIT website, sandbox environment, application, and APIs (together, the "Service"), operated by the FINSAIT entity based in Barcelona, Spain ("FINSAIT", "we", "us"). By accessing the Service you agree to be bound by these Terms; if you are accepting on behalf of an organisation, you confirm you have authority to do so.

If you have a separately signed pilot agreement, master services agreement or data processing agreement with FINSAIT, that document controls over any conflicting provision here.

2. The service

FINSAIT is an AI-augmented treasury intelligence platform. The Service includes cash position visibility, forecasting, risk simulation, working-capital analytics, and related features described on our website and in your account.

The Service is intelligence, not advice. FINSAIT supports treasury decision-making with data, models and scenarios. It does not provide financial, investment, tax, accounting or legal advice. You are responsible for the decisions you make using outputs from the Service.

3. Accounts & access

3.1 Access model

Today, access to the full Service is provided by invitation. After you submit a request via the website, we review it and, where appropriate, issue a time-limited guest login that grants access to a sandbox tenant pre-loaded with synthetic data. Engine-demo endpoints on the marketing site may be used without an account, subject to fair-use rate limits.

3.2 Authentication

Accounts are authenticated through our identity provider (Auth0). You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at hello@finsait.com if you suspect unauthorised access.

3.3 Eligibility

You must be at least 18 years old and acting on behalf of a legitimate business purpose. The Service is not directed at consumers.

4. Acceptable use

You will not, and will not allow anyone else to:

  • Use the Service in violation of any applicable law or third-party right
  • Upload data you do not have the right to upload, or data containing malware
  • Attempt to access another tenant's data, or otherwise probe, scan or test the security of the Service except under a written authorisation
  • Reverse engineer, decompile, or extract the underlying models, algorithms or training data of the Service
  • Use the Service to build a competing product, or to scrape or replicate any benchmark or aggregate output
  • Resell, sublicense or white-label the Service without a written agreement
  • Use the Service to generate excessive load, including by automated traffic outside documented API rate limits

5. Your data & content

5.1 Ownership

You retain all rights in the data you upload, connect or transmit to the Service ("Customer Data"). You grant FINSAIT a worldwide, non-exclusive licence to process Customer Data solely to deliver the Service to you, comply with our obligations, and improve the Service in accordance with our Privacy Policy.

5.2 Treasury Intelligence Network

If you opt in to the Treasury Intelligence Network, you also permit FINSAIT to derive and publish anonymised aggregate statistics from your Customer Data, subject to the safeguards described in section 4 of the Privacy Policy (k-anonymity, aggregation, suppression of small cells). Opt-in is granular and reversible.

5.3 Data export & deletion

You can export your Customer Data in standard formats at any time during your subscription. On account closure, we will provide a final export and delete your Customer Data within 30 days, except where retention is required by law.

6. Intellectual property

The Service, including all software, models, designs, content and trade marks, is owned by FINSAIT or its licensors and protected by intellectual-property laws. Nothing in these Terms transfers ownership of any FINSAIT IP to you. Feedback you give us about the Service may be used by us without obligation, though we will not attribute it back to you without consent.

7. Fees & billing

Sandbox guest access during the invitation period is provided free of charge. Paid plans, proof-of-concept fees and pilot terms are agreed in writing on a per-customer basis. Pricing displayed on the website is indicative for the pre-launch period and may change before general availability. We will not charge you any fee that you have not separately agreed to in writing.

8. Warranties & disclaimers

We provide the Service with commercially reasonable care and skill. To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of forecasts, and non-infringement. Forecasts, risk simulations and recommendations are probabilistic by nature and are not guarantees of future outcomes.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising out of or in connection with the Service, even if advised of the possibility of such damages.

Each party's aggregate liability arising out of or related to the Service in any 12-month period will not exceed the fees you paid to FINSAIT for the Service in that period; for sandbox-only or pre-paid pilot use, this cap will not exceed €1,000. Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, or any other liability that cannot be excluded by law.

10. Indemnification

You will defend and indemnify FINSAIT against third-party claims arising from your breach of these Terms, your violation of law, or your Customer Data infringing third-party rights. We will defend and indemnify you against third-party claims that the Service, as provided by us and used in accordance with these Terms, infringes that party's intellectual-property rights, subject to standard carve-outs (modifications, combinations, use outside scope).

11. Suspension & termination

We may suspend or terminate your access if you materially breach these Terms, if we are required to do so by law, or if continued provision creates a material risk to the Service or other users. Where the breach is curable, we will give you notice and a reasonable opportunity to cure. You may stop using the Service at any time. On termination, your right to access the Service ends, and the data-handling provisions of section 5.3 apply.

12. Changes to these terms

We may update these Terms as the Service evolves. Material changes will be highlighted on this page and, for users with an account, notified by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Spain. The courts of Barcelona will have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. If you are a consumer (which the Service is not directed at), nothing in this section deprives you of mandatory protections of the law of your habitual residence.
